William Burke Academy- Modernization (the “Contract”),
as per the Contract Documents, including the drawings and specifications, which may now be obtained electronically from the Architect, who is

The lowest bid shall be determined on the amount of the base bid.
This Contract is subject to prequalification pursuant to Public Contract Codesection 20111.6 and to the PLA “Community Workforce Agreement for the Alameda County Office of Education”. For more information, refer to our website. This Contract is subject to the DVBE requirements of Education Code 1707611.
Public works projects shall be subject to compliance monitoring and enforcement by the Department of Industrial Relations. For all projects over Twenty-Five Thousand Dollars ($25,000), a contractor or subcontractor shall not be qualified to submit a bid or to be listed in a bid proposal subject to the requirements of Public Contract Code section 4104 unless currently registered and qualified under Labor Code section 1725.5 to perform public work as defined by Division 2, Part 7, Chapter 1 (§§1720 et seq.) of the Labor Code. For all projects over Twenty-Five Thousand Dollars ($25,000), a contractor or subcontractor shall not be qualified to enter into, or engage in the performance of, any contract of public work (as defined by Division 2, Part 7, Chapter 1 (§§1720 et seq.) of the Labor Code) unless currently registered and qualified under Labor Code section 1725.5 to perform public work and proof of registration is provided.
The anticipated construction start is June 19, 2023 and the deadline for completion is August 9, 2023. See Article III of the Agreement for details.
Bids must be sealed and filed at Alameda County Office of Education, 313 West Winton Avenue, Hayward, CA 94544 (Attention Patrick Yu)
This project is estimated at $2.3 Million.
On March 28, 2023 before 02:00 pm on the clock designated by the Owner or its representative as the bid clock. No bid will be accepted by the Owner after this time. Facsimile (FAX) copies of the bid will not be accepted. Bids may be opened immediately after the above deadline for submittal, or at a later time, within the Owner’s discretion.
Mandatory pre-bid conference will be held on March 9, 2023 at 04:00 pm at William Burke Academy located at 612 West A Street in Hayward. (Meet by the flagpole initially). Bidders not attending the pre-bid conference will be disqualified.
Bids must be accompanied by a bidder’s bond, cashier’s check, or certified check for at least ten percent (10%) of the amount of the base bid and made payable to the Owner, as detailed in the Contract Documents.
Pursuant to the Contract Documents, the successful bidder will be required to furnish a Payment (Labor and Material) Bond in the amount of one hundred percent (100%) of the Contract Sum, and a Faithful Performance Bond in the amount of one hundred percent (100%) of the Contract Sum.
The successful bidder will be allowed to substitute securities or establish an escrow in lieu of retainage, pursuant to Public Contract Code Section 22300, and as described in the Agreement Between Owner and Contractor and General Conditions.
The Owner will not consider or accept any bids from contractors who are not licensed to do business in the State of California, in accordance with the California Public Contract Code, providing for the licensing of contractors. In accordance with Section 3300 of said Code, the bidder shall have a Class “B” license at the time of award and shall maintain that license in good standing through Completion of the Contract and all applicable warranty periods. For all projects over Twenty-Five Thousand Dollars ($25,000), the bidder shall state the public works contractor registration number on the Designation of Subcontractors form for each subcontractor performing more than one-half of one percent (0.5%) of the bidder’s total bid.
The Director of Industrial Relations of the State of California, in the manner provided by law, has ascertained the general prevailing rate of per diem wages and rate for legal holidays and overtime work. The Contractor must pay for any labor therein described or classified in an amount not less than the rates specified. Copies of the required rates are on file at the Owner’s business office and are available on request.

On behalf of the ACTION Co-Op we want to inform you that due to the current crisis and continued school closures in Alameda County, we have extended the proposal due date to Friday, May 29, 2020, at 12:00 PM (pst). Due to the shelter in place order, email your proposals to Joshua Roben, Alameda County Office of Education at jroben@acoe.org. Follow the RFP instructions in regards to submitting proposals. Remember to provide all Nutrition Information and Product Formulation Statements when submitting your proposal.
ACTION is working on the logistics to facilitate the public viewing period, including what limitations will be in place that would impact our ability to hold the one-hour in-person period. Further COVID-19 updates from County Health Officials and the County Superintendent of Schools will guide any changes.

PROPOSAL QUESTIONS
Question #1: Given the ever changing rules and orders with the Covid-19 Virus, has there been consideration in just asking if you can rollover another year? Or, can the bid rules be changed so that a bid can just be sent in electronically? These are unprecedented times and past norms aren't necessarily going to work. I am even concerned about trying to send a bid via the mail or delivery service.
Answer #1: Given the County Health Orders to Shelter In Place and most recently Lockdown across the State, ACTION is amending the submission guidelines and original proposal opening review period. At this time ACTION will accept proposal by the stated submission deadline via Flash Drive and additionally request the electronic Excel file emailed to jroben@acoe.org before the submission deadline.
Question #2: The Paper and Snacks bids are all-or-nothing (one single supplier) and the Grocery bid is line-item awarded items. I would like to request for the future that the Paper bid (our specialty) be awarded by line-item, as it would ensure the best price on all items. Do vendors need to list ACTION (All Districts) on the Certificate of Insurance before any award is made?
Answer #2: The proposal for 2020-2021 will remain as posted. I will follow up with our co-op about potentially changing the proposals to be awarded by individual line item in the future. The requirement to provide insurance documents only requires a proof of insurance be submitted with the proposal. Only vendors awarded a particular proposal will be required to name ACTION and it district members on Certificate of Insurance documents.

Can you please clarify your bid lines on your Grocery bid? For example, for mustard you have "qty 80." However, under mustard you have Packs - 245; Pumps - 10; Gallons - 45. Do you need a total of 80, 245, 10, or 45?
It looks like a clerical error. Please combine the 80 with the 245 for a total of 325. We apologize for any confusion. Thanks for catching that one!

NOTICE OF INTENT TO AWARD
Alameda County Office of Education (ACOE) has completed the review of the proposals for the CARSNet Charter School Authorizers On-Line Monitoring System. We have selected the National Charter School Institute and its Epicenter system to meet the objectives and provide the functionality described in the RFP. We look forward to reaching agreement on the implementation of the system for the grant term, and laying the foundation for long-term support of California’s charter authorizing agencies.
ACOE is grateful to each firm that participated in the CARSNet Authorizers On-Line Monitoring System RFP process.
